Welcome to Clark Deals, LLC ("Clark Deals," "we," "our," or "us"). By purchasing products from Clark Deals or using our website, you agree to the following Terms of Service.

1. Products

Clark Deals sells surplus, canceled-order, overstock, showroom, and mismeasured windows and doors. Inventory is limited and unique. Product availability is not guaranteed until payment has been received.

Product descriptions, dimensions, specifications, colors, and photos are provided to the best of our ability but may contain errors or omissions.

Customers are responsible for verifying that a product meets their needs before purchasing.

2. Pricing

Prices are subject to change without notice.

Items are sold on a first-come, first-served basis unless otherwise agreed in writing.

Clark Deals reserves the right to correct pricing errors at any time.

3. Sales Final

ALL SALES ARE FINAL.

All products are sold AS IS, WHERE IS, with no warranties expressed or implied unless otherwise stated in writing.

Due to the unique nature of surplus and special-order inventory:

  • No returns
  • No exchanges
  • No refunds
  • No cancellations after purchase

Customers are encouraged to inspect products before taking possession.

4. Inspection and Acceptance

Customers are responsible for inspecting products before pickup.

By accepting possession of an item, the customer acknowledges that:

  • The item matches the product purchased.
  • The item is in acceptable condition.
  • The customer has verified dimensions and specifications.

Claims regarding visible damage or discrepancies must be reported before the item leaves our facility.

5. Pickup and Transportation

Customers are responsible for:

  • Loading purchased products. (I will help ha) 
  • Securing products during transport.
  • Following all applicable transportation laws.

Clark Deals is not responsible for damage occurring after products leave our warehouse.

6. Installation

Clark Deals does not provide installation services 

Customers are responsible for:

  • Confirming measurements.
  • Determining building code compliance.
  • Hiring qualified installers when necessary.

Clark Deals is not responsible for installation errors, measurement mistakes, labor costs, project delays, or related expenses.

7. Limitation of Liability

To the fullest extent permitted by law, Clark Deals shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Lost profits
  • Lost business opportunities
  • Installation costs
  • Contractor expenses
  • Delays
  • Property damage arising from misuse or improper installation

Our maximum liability shall not exceed the amount paid for the product.

8. Website Information

We strive to provide accurate information but do not guarantee that all website content is complete, accurate, or current.

Inventory, pricing, descriptions, and availability may change without notice.

9. Intellectual Property

All content on this website, including photographs, logos, graphics, and text, is the property of Clark Deals, LLC and may not be copied or used without written permission.

10. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Kentucky without regard to conflict of law principles.
